# Accessibility criticism, marketing and the company’s replies

**Question.** How do the criticism, company responses and later apology fit together?

**Answer.** Advocates challenged product and marketing claims; accessiBe disputed aspects of the criticism and later apologized for its approach. Historical disputes are not a fresh technical audit.

## Nfb

- Analysis: The National Federation of the Blind revoked accessiBe’s sponsorship of its 2021 convention on 22 June 2021, citing its treatment of blind people’s concerns and expertise. In May 2023 Ekerling’s letter to the community apologized for dismissive reactions and for marketing centered on avoiding lawsuits, and announced changes in the marketing team and campaigns. [s-d25] [s-d179] [s-d180] [s-d216] [s-d217] [s-d263] [s-d315]
  - Qualification: The primary statement dates the revocation to 2021; a secondary account’s 2020 date is incorrect. The apology does not establish a renewed sponsorship or NFB approval of the product.
  - Response: The company’s later account emphasizes listening to the disability community and a change in its marketing approach.
  - Outcome: The retained record includes the apology but does not establish restoration of convention sponsorship.

## Critics

- Analysis: The Overlay Fact Sheet identifies accessiBe among overlay examples and argues that overlays cannot alone provide complete standards conformance or remove legal risk. Its signatories include Steve Faulkner, Haben Girma, Adrian Roselli, Karl Groves and Lainey Feingold. Several also supplied comments in the FTC matter; some critics work for accessibility service providers. [s-d69] [s-d70] [s-d215] [s-d216] [s-d251] [s-d258] [s-d263] [s-d315]
  - Qualification: The statement is an attributed professional and user position, not a court judgment. Their distinct professional and advocacy roles are retained without treating commercial competition as disproof or treating every participant as an independent source for the same statement.
  - Response: In 2021 accessiBe described a learning curve for users, said some criticism came from competitors and maintained that critics had not adequately tested its product.

## Testing criticism

- Analysis: Retained critical accounts describe screen-reader barriers, interference with automated testing, users blocking overlay scripts, and disagreement over claims of collaboration with JAWS developers. They also summarize broader studies of overlays and raise privacy questions. [s-d215] [s-d216] [s-d224] [s-d310] [s-d315]
  - Qualification: These reports concern particular tests, user experiences or secondhand studies, not a fresh technical audit of current accessWidget. The original supplier denial, privacy assessment and every cited study are not retained. No privacy-law violation is established.
  - Response: Ekerling acknowledged in a reported 2023 interview that the overlay was not a perfect solution; he also denied user tracking or selling data. Earlier responses disputed critics’ testing and explained increased automated-checker counts as a consequence of code changes.

## Marketing history

- Analysis: Historical company materials promoted rapid or automatic WCAG and ADA compliance and protection from accessibility lawsuits. Retained examples include 48-hour remediation claims, recurring scans, subscription onboarding messages and statements of litigation support. [s-d25] [s-d32] [s-d48] [s-d65] [s-d77] [s-d101] [s-d168] [s-d224]
  - Qualification: These are historical representations, not this publication’s certification of the product or a finding that every current page repeats them.
  - Response: Ekerling later said the company had removed litigation-avoidance wording, and the company announced changes to its marketing.
  - Outcome: The FTC’s final order requires non-misleading compliance representations supported by competent and reliable evidence; the July 2026 pledge change further limits which customers receive that contractual benefit.

## Marketing disputes

- Analysis: The retained critical record contains disputes over promotional articles, online reviews, deleted comments, technical claims and exchanges with blind users. It also records company responses: that marketing agencies were used, tweets were not paid for, some technical statements needed correction, and a silent majority of users was satisfied. [s-d216] [s-d360]
  - Qualification: Many individual allegations are commentary, copied screenshots or summaries whose underlying platform records were not retained. They are not treated as additional regulatory findings or as proof that a particular investor’s agency ran a campaign. Criticism of the size of the FTC payment is opinion.
  - Response: The company disputed several accounts and later apologized for its approach to community criticism; the FTC settlement involved no admission of its allegations.
