# Holding recovery claims: demands, settlements and limits

**Question.** Which Holding recovery figures are claims, and which are outcomes?

**Answer.** The record contains large disputed demands and selected recovery outcomes; their procedural stages and legal counterparties must remain distinct.

## Avoidance claims before the courts

- Analysis: In March 2025 Stapf reported avoidance suits exceeding EUR 312 million. Named demands included EUR 46.5 million against INGBE over Garda villas, EUR 56 million against Laura, almost EUR 1.4 million against Gusenbauer, EUR 3.5 million against his consulting GmbH and EUR 396,000 against Karl Samstag. These were disputed claims, not awards or recovered cash. By May 2026 the approximately EUR 46.4 million INGBE dispute had ended in a confidential settlement. Laura claims then totalled approximately EUR 74 million and were interrupted by its insolvency, with claims lodged there; Herkules disputed its separate EUR 11.7 million demand. The later figures and stages do not silently replace the earlier account. [s-d224] [s-d174]
- Attributed: In March 2025, administrator Christof Stapf reported avoidance suits exceeding EUR 312 million. Reported claims included EUR 46.5 million against INGBE Stiftung over Garda villas, EUR 56 million against Laura Privatstiftung, almost EUR 1.4 million against Alfred Gusenbauer, EUR 3.5 million against his consulting GmbH and EUR 396,000 against former advisory-board member Karl Samstag. [s-d224] [s-d174]
  - Qualification: These are disputed recovery claims, not awards. The administrator said advisory-board meetings and proof of services were absent and that Holding’s managing directors denied having received the claimed advice.
  - Outcome: By May 2026 the Holding estate’s approximately EUR46.4 million Ingbe dispute had ended in a confidential judicial settlement; its terms and merits were not disclosed. By May 2026 claims against Laura totalled approximately EUR74 million and were interrupted by its insolvency, with claims lodged in that proceeding. Herkules disputed its separate EUR11.7 million claim.
- Attributed: By May 2026 Stapf reported EUR 8.7 million recovered and roughly EUR 160 million claims still pending, including EUR 9.2 million concerning TPA, about EUR 5 million against Alfred Gusenbauer and his company, EUR 396,000 against Karl Samstag and A&I, about EUR 74 million against Laura Privatstiftung, and EUR 11.7 million against Herkules Holding. BDO settled for EUR 1.4 million; the EUR 46.4 million Ingbe dispute ended in a confidential judicial settlement. [s-d174]
  - Qualification: Claim sums and recoveries are procedural snapshots. Confidential settlements do not disclose merits or all paid sums, and claims pending against Laura were interrupted by its insolvency.
  - Response: Herkules Holding disputed the EUR 11.7 million claim; terms of the Ingbe settlement were confidential.
  - Outcome: BDO reached a EUR 1.4 million settlement; Ingbe’s EUR 46.4 million dispute ended in a confidential settlement. Laura claims were lodged in its insolvency and Herkules contested its claim.
- Analysis: The fee claims were reportedly based on the absence of advisory-board meetings and proof of services, with Holding’s managers denying they had received the claimed advice. As of May 2026 the approximately EUR 5 million Gusenbauer dispute was still expected to take months; the Samstag hearing had been delayed until November 2026 because of illness. Neither pending date determines whether the fees must ultimately be repaid. [s-d224] [s-d174]
- Attributed: A May 2026 account of Stapf’s report says the administrator still sought approximately EUR 5 million from Alfred Gusenbauer and his consulting GmbH and expected hearings to continue for months. [s-d174]
  - Qualification: This is the pending civil recovery dispute, not a judgment ordering repayment. The same account separately records a EUR 1.4 million BDO settlement and a EUR 9.2 million TPA dispute.

## A settlement and a separate professional-services dispute

- Analysis: Stapf’s May 2026 report said EUR 8.7 million had been recovered for the Holding estate and further avoidance, liability and damages claims with around EUR 160 million disputed value remained pending. It separately records a EUR 1.4 million BDO settlement and a EUR 9.2 million TPA dispute. Recovery, disputed claim value and settlement face amounts are different measures: confidential terms do not disclose all paid sums, and a settlement does not establish every alleged accounting failure or the liability of other professionals. [s-d174]

## Share values and collective claims

- Analysis: In March 2025 Stapf expected no recovery from Holding’s interests in Prime and Development, held through intermediate companies, considering them to have at most scrap value. This was a valuation of Holding’s investment strands, not a finding that all underlying group buildings had no value or a completed realisation result. Prime and Development administrators pursued separate collective manager and supervisory-board claims; the reported approximately EUR 1 billion Prime demand and 2026 settlement discussions were not adjudicated personal liabilities of each named director. [s-d224] [s-d245]
- Analysis: The directors-and-officers insurer was reported to have an annual EUR 105 million limit and to claim it had been misled in a 2013 questionnaire concerning Benko’s practical role. That is a reported contractual position, not a judgment on deception, an adjudicated denial of coverage or the sum creditors will recover. Benko has disputed assertions that he was Holding’s de facto manager. [s-d245] [s-d187]
