the questionHow did Laura Privatstiftung enter insolvency, and where were its assets held?

1Foundation and separate asset companies

analysisLaura Privatstiftung was founded by René and Ingeborg Benko in December 2006 and registered in Innsbruck on 30 January 2007, FN 287704w, to support beneficiaries. René subsequently ceased to be a beneficiary under an amendment. The current retained register lists Christof Jauschnegg, Thomas Peter Limberger and Luitpold Wüsthof as board members, and Stefan Geiler, Simon Schafferer and Stefan Dorner as insolvency administrators from 12 March 2026. 1 2

attributedLaura Privatstiftung was founded by René Benko and Ingeborg Benko in December 2006 and registered in early 2007. The retained account describes support for the founders and Benko’s descendants as its purpose and says René Benko later ceased to be a beneficiary after an amendment. 1 2

qualification
The official register gives 30 January 2007 as the registration date. Former beneficiary status is separate from alleged practical influence over the foundation.

documentedLaura Privatstiftung, FN 287704w, was registered in Innsbruck on 30 January 2007 to support beneficiaries. Its retained official record lists Christof Jauschnegg from 28 June 2024, Thomas Peter Limberger from 17 December 2024 and Luitpold Wüsthof from 2 April 2025 on the board. Stefan Geiler, Simon Schafferer and Stefan Dorner were entered as insolvency administrators on 12 March 2026. 2

qualification
The March 2026 record preserves the distinction between board representation dates and insolvency-administrator registration dates. Earlier officeholders are not disproved merely because the current card omits them.

analysisThe retained May 2026 account describes earlier reported asset values of approximately EUR 750 million in summer 2023 and EUR 250 million in 2024; the administrator did not give a definitive current total. Assets lay through subsidiaries and subsubsidiaries, expressly described in the source as not insolvent. Properties, startup stakes and company interests cannot be treated as a cash balance held directly by the foundation. Laura Demeter’s official record contains no insolvency entry; Laura Heli was separately in liquidation. Another company bearing the Laura name, Laura 2017 Drei, is owned by Prime Holding and must not be assigned to the foundation by name. 1 3 4 5 6

2Awards and creditor claims

analysisThe May 2026 account reports over 30 creditors lodging approximately EUR 1.7 billion against Laura. ICC awards in Geneva requiring more than EUR 900 million including interest were reported as the trigger for its own insolvency application; Mubadala was awarded somewhat more than EUR 700 million over financing agreements. Other Signa companies and Familie Benko Privatstiftung were also bound. These award amounts are different from the total claims lodged in insolvency, and neither gives the cash available or a predicted recovery. 1

attributedA May 2026 insolvency account reports more than 30 creditors lodging approximately EUR 1.7 billion against Laura Privatstiftung. ICC awards in Geneva requiring more than EUR 900 million including interest reportedly precipitated its own insolvency filing; Mubadala was awarded somewhat more than EUR 700 million over financing agreements. Other Signa entities and Familie Benko Privatstiftung were also bound by the awards. 1

qualification
Filed creditor claims are not amounts admitted, assets available or expected recoveries. Mubadala’s group name does not identify the exact subsidiary that invested. Laura’s co-liability with Familie Benko Privatstiftung is not ownership of one foundation by the other.

analysisReported asset-preservation proceedings had already touched the family’s indirect holdings. A Guernsey order in June 2024 prohibited dealing with proceeds of the yacht RoMa, held by a Laura subsidiary, until further order. The reported EUR 25 million price and Paul van Zuydam as buyer were hearsay in the retained account. An interim freeze is not an adjudication of every financing allegation. 2

3Innsbruck sales and professional roles

analysisA retained May 2026 investigation reports more than EUR 30 million of property sales in the weeks between an arbitration decision and the foundation’s insolvency. The properties include Museumstrasse 25, Museumstrasse 9–11, Adamgasse 9 and Meraner Strasse 1. A ten-property portfolio had an internal 2023 valuation of EUR 127 million and secured EUR 70 million of Volkswohl Bund bond financing, partly to 2067 at around 3% fixed interest. The internal valuation covered a broader portfolio at an earlier date than the sales and cannot be directly compared with partial sale proceeds. 1

attributedA retained May 2026 investigation reports that companies indirectly held by Laura Privatstiftung sold Innsbruck properties, including Museumstrasse 25, Museumstrasse 9–11, Adamgasse 9 and Meraner Strasse 1, for more than EUR 30 million in the weeks between an arbitration award and the foundation’s insolvency. A ten-property portfolio was internally valued at EUR 127 million in 2023 and secured EUR 70 million of Volkswohl Bund bond financing, partly extending to 2067 at around 3% fixed interest. 1

qualification
The buildings were owned by subsidiaries or subsubsidiaries, not the foundation itself. The EUR 127 million was an internal valuation at a different date from the sales; it is not directly comparable with proceeds from only the buildings sold.
response
Stefan Geiler said his firm had acted as trustee, the transactions concerned subsidiary companies, and its involvement was disclosed. The court’s clarified statement says disclosure occurred before his appointment and a special administrator could examine any resulting issue. The clarified court account identifies the firm’s partner, rather than Geiler himself, as the contract drafter and trustee; the sellers were non-insolvent subsubsidiaries.

analysisUGP partners accompanied the transactions and were later appointed administrators. Stefan Geiler said the firm acted as trustee and the transactions belonged to subsidiary companies; a special administrator could review any resulting issue. The court’s clarified account says the relevant partner, not Geiler personally, drafted contracts and acted as trustee, and that involvement was disclosed before appointment. The owners were non-insolvent subsubsidiaries. Disclosure and different professional capacities do not themselves decide whether each price was fair or whether an improper conflict existed. 1

analysisThe reported Museumstrasse 9–11 contract had a EUR 15 million price and became effective only on 19 March 2026 when a suspensive condition was met, after the foundation’s insolvency opened. A VAT-related amendment prompted new notarisation on 31 March, with a UGP partner acting as transaction lawyer. The building’s internal 2023 valuation was EUR 17.2 million. The dates and capacity overlap explain the question raised, but the retained material does not supply an adverse valuation judgment or a finding that the sale was unlawful. 1

attributedA retained contract account says the EUR 15 million sale of Museumstrasse 9–11 became effective on 19 March 2026 when a suspensive condition was met, after Laura Privatstiftung’s insolvency opened. The contract was amended to show the price without VAT and notarised again on 31 March by a UGP partner acting as the transaction lawyer. The building had an internal 2023 valuation of EUR 17.2 million. 1

qualification
The selling company was a non-insolvent subsidiary/subsubsidiary. The source’s timing and different professional capacities raise a reported conflict question but are not a finding of illegality or an adverse valuation ruling.
response
The court said the law-firm partner’s transaction role had been disclosed before appointment; Geiler said a special administrator could review any issue.

4Foundation assets and separate company vehicles

analysisThe historical financial account gives Laura Privatstiftung cash of EUR1.8 million for 2022, compared with EUR31.2 million a year earlier. It identifies the foundation as owner of the Igls residence and reports that this prevented attachment of its underground pool for a time; its own insolvency filing came in March 2026. These are different matters from Benko’s separate advance-rent prosecution concerning the Hungerburg property. The foundation’s asset holdings do not by themselves establish that Benko was their legal owner. 1 2 3

qualification
The ownership and attachment account is secondary; temporary protection from attachment is not a finding of illegal concealment.

attributedA retained account reports Laura Privatstiftung's cash at EUR 1.8 million for 2022, versus EUR 31.2 million a year earlier. 1

qualification
These are secondary reported annual-account values and not a current liquidity measure.

attributedA retained account reports monthly costs of EUR 238,500 for the Igls residence, officially paid by Ingeborg Benko and indirectly by Laura Privatstiftung and Ingbe Stiftung. 1 2 3

qualification
The reported payments concern the Igls residence, not the separate EUR 360,000 advance-rent prosecution for the Hungerburg property.

analysisThe corporate structure also includes Laura Holding, later Herkules Holding, and Laura Finance Holding, later Herkules Finance Holding. March 2025 reporting gives Laura Privatstiftung around 42% of Herkules Holding, Ameria Invest 34.9%, Fressnapf Luxembourg and AE Familienholding 10% each, and Ernst Tanner 3%. A later account uses 42.1% for Laura. Herkules Holding was sole owner of the finance company and owner of Am Hof 2 Hotelbetriebs, Park Hyatt Vienna’s operator. The operator is distinct from the legal owner of the building; a proposed property sale did not establish an operator sale. 4 5 6

qualification
The rounded percentages total 99.9%; other reporting gives Laura 42.1%. Herkules Holding is the Innsbruck successor name of Laura Holding, not a similarly named Vienna asset-management company.

attributedSeptember 2025 reporting identifies Herkules Holding, formerly Laura Holding, as owner of Park Hyatt Vienna's operator Am Hof 2 Hotelbetriebs GmbH and gives Laura Privatstiftung's stake in Herkules as 42.1% and Ameria Invest's as 34.9%. A prospective EUR 330–335 million building sale was reported, with acquisition of the operator still uncertain. 5

qualification
A proposed building sale does not establish an operator-company sale. The exact legal owner of the property and operator are distinct; reporting varies Laura’s percentage between 42% and 42.1%.

analysisArual is another distinct foundation, identified as founded by Laura Privatstiftung and holding Villa Ansaldi through intermediate companies. The reported chain runs through Swiss Vorstadt Holding and Luxembourg Landgraf, the villa’s lessor to SIGNA Holding. Describing that path explains the association without skipping companies or assigning ownership of the villa directly to every person or foundation on the route. A source’s report that rent was funded indirectly through foundations is also different from a legal title record. 1 7 2 3

qualification
Foundation ownership is indirect; Laura’s founding role does not make it direct legal owner of the villa or prove Benko personally owned foundation assets.
